    The order of the granting of rights to land plots for individual housing construction and maintenance of private farming
    The procedure for granting rights to land plots for individual housing construction and maintenance of private farming (hereinafter referred to individual housing and LPH, respectively) is regulated by the norms of the Land Code of the RK and the Rules of granting of rights to land plots for individual housing construction, approved by Government Resolution № 726 of 01.08.2006goda.
    Plots are available free of charge to citizens of Kazakhstan to private ownership for individual housing construction in the amount of 0.10 ha and under LPH of 0.25 hectares.
    Re-free provision of land for these purposes is not allowed.
    Foreign citizens and stateless persons plots for individual housing can be provided in a private property on a reimbursable basis, through foreclosure. Land plots for smallholders can be leased for 10 years.
    To get the land the persons concerned to apply for land in the relevant local executive bodies (Mayor of the city, town, village), at the location of the requested land.
    The application includes: the purpose of use of land, it assumed dimensions, location, the right to use the requested and the presence (absence) of other land for individual housing construction and (or) LPH.
    Attached to the application:
    1) a copy of identity document;
    2) a copy of the registration number of the taxpayer;
    3) information about the presence or absence of a national land rights that were previously granted to individual housing, LPH (issued within seven days of the authorized body on land relations on the location of the claimed land;
    4) information about the presence or absence of a citizen's private housing (issued within seven days, the body conducting the registration of real estate).
    Information about the presence or absence of land in the townships, villages (villages) can give mayors of the village (the village).
    When making a statement not allowed to demand other documents and information not covered by these Rules.
    Application for land for individual housing, LPH treated within two months from the date of its receipt.
    The decision to grant land take:
    within the boundaries of regional importance - Akim of district importance;
    within the boundaries of the village - village mayor;
    within the boundaries of the aul (village) - Mayor aul (village), aul (rural) district.
    The decision to grant land or refuse to provide is made based on conclusions of the commission established in accordance with paragraph 2 of Article 43 of the Land Code of the Republic of Kazakhstan (hereinafter - Commission).
    In preparation for the commission's conclusions into account suggestions of the authorized bodies on land relations and local architecture and town planning at the location of the land of the possibility of its use for individual housing, LPH.
    Refusal to grant rights to land, except in cases of confiscation of land for public needs in accordance with Article 84 of the Land Code of the Republic of Kazakhstan, issued the decision of the local executive body and must be motivated, and a copy given to the applicant within seven days after the decision.
    The decision of the local executive authority to grant appropriate rights to land plots shall be based on land use planning project with the award the applicant a copy of the decision granting the right to ownership of the land within seven days after the decision.

    After the decision to grant land to private property shall manufacture and issue an act on private ownership of land, which are produced within one month from the time the person who was granted land for individual housing, LPH.
    Land survey work to establish the boundaries of the land and making the act on private ownership of land shall be covered by the person who provided the land.
