  • Regulations of the rendering state facilities Issue of the acts on right temporary land-uses

    Concepts
    Definitions of terms and abbreviations:
    1) State - the state agency;
    2) ESF - the structural functional unit;
    3) CSC - Citizen Service Center (hereinafter Center)
    4) Consumers - individuals and legal entities, which is public service.

    Main notions

    1. The acts at right time compensated (long, short) use (lease).
    2. These public service provides a public institution, "Department of land relations Tarbagatai District" (hereinafter - the Department) and through the center of public service ((the center)

    4. Public service is provided on the basis of Article 23, paragraph 9 of article 43, article 152 of the Land Code of the Republic of Kazakhstan, Article 26 of the Law of the Republic of Kazakhstan "On state-owned enterprise" and subparagraph 1) of paragraph 1 of the Government of Kazakhstan on June 6, 2006 № 511 "On Approval of Forms identification documents of the land, Amendments and Repeal of certain decisions of the Government of the Republic of Kazakhstan ", paragraph 70 of resolution of the Government of the Republic of Kazakhstan dated June 30, 2007 № 561" On approval of the roster of state services to individuals and legal entities, "paragraph 2 Resolution of the Government of the Republic of Kazakhstan dated January 5, 2007 № 1 "On the creation of state institutions - for service of the Ministry of Justice of the Republic of Kazakhstan"
    Form completion (result) is provided by the public service act for the right time compensated (long, short) use (lease).

    Requirements to order of the rendering state facilities

    6. Public service is: when you contact the authorized body, five days a week, except holidays, from 8-30 hours to 18-00 hours with a lunch break from 12-30 to 14-00 hours.     7.     8.     9. Submission of documents to provide the public service carries out specialist PI, in the heart of acceptance of documents is carried out through "windows" in which information about the purpose and functions as a "window", as well as the surname, name and title of inspector Center. 10.1 with the provision of public services through the public authority:
    1) Received documents are checked by the authorized body and sent to a specialized company for manufacture of the act for the right time compensated (long, short), land (rent) within 2 (two) working days

    3) The authorized body checks made for the right to act temporarily compensated (long, short), land (rent) for 2 (two) working days, signed by the head (or acting head) and approved by the official seal, records in the book of Acts for the right to issue temporary Paid (long, short) use (lease). Small business: 1) Received documents are checked by the authorized body and sent to a specialized company for manufacture of the act for the right time compensated (long, short), land (rent) within one (1) working day 2) The specialized enterprise produces, transmits to act Paid right time (long, short) use (lease) to the authority within 4 (four) working days 3) The authorized body checks made for the right to act temporarily compensated (long, short), land (rent) within 2 (two) working days, signs the manager (or acting head) and approved by the official seal, records in the book of Acts for the right to issue temporary Paid (long, short) use (lease). In case of errors and inaccuracies documents are returned to a specialized company to remove them in the same day.
    11.2.Provision of state services through the PSC inspector checks the completeness TsONa documents, records in the log and sends an inspector of savings. Inspector accumulation of the center has been collecting documents of the register and sent to the authority. Delivery of the appropriate authorities of applications with attached documents, and back and forth by the center through courier at least 2 times a day, data acquisition applications.
    11.2.Pri provision of state services through the PSC inspector checks the completeness TsONa documents, records in the log and sends an inspector of savings.

    2) The specialized enterprise produces, conveys the right to act temporarily compensated (long, short) use (lease) to the authority within six (6) working days
    3) The authorized body checks made for the right to act temporarily compensated (long, short), land (rent) within 2 (two) working days, sign the manager (or acting head) and approved by the official seal, records in the book of Acts for the right to issue temporary Paid (long, short) use (lease), forms a roster full of documents and send to the PSC for the issue.
    For small businesses:
    TsONa inspector checks completeness of documents, records in the log and sends an inspector of savings.
    Inspector accumulation of TsONa collects documents of the register and sent to the authority.
    Delivery of the appropriate authorities of applications with attached documents, and back and forth by TsONom through courier at least 2 times a day, data acquisition applications.
    1) The adopted documents are checked by the authorized body and sent to a specialized company to produce an act for the right time compensated (long, short), land (rent) within one (1) working day.
    2) The specialized enterprise produces, conveys the right to act temporarily compensated (long, short) use (lease) to the authority within 4 (four) working days
    3) The authorized body checks made for the right to act temporarily compensated (long, short), land (rent) within 2 (two) working days, sign the manager (or acting head) and approved by the official seal, records in the book of Acts for the right to issue temporary Paid (long, short) use (lease), forms a roster full of documents and send to the PSC for the issue.
    12. The authority granted to the consumer's receipt of receiving the documents referred to in paragraph 16 of this Regulation, indicating the
    1) The number and date of receiving the request;
    2) the requested form of public service;
    3) the number and names of attached documents;
    4) the date (time) and place of issuance;
    5) name, surname, patronymic and position of the person who accepted the application for the provision of public services.
    When you receive documents via the Center for the consumer is issued a receipt for the admission of the documents referred to in paragraph 16 of this Regulation, stating:
    1) The number and date of receiving the request;
    2) the requested form of public service
    3) the number and names of attached documents;
    4) the date (time) and place of issuance;
    5) the surname, name and patronymic inspector Center, has accepted an application for registration of documents.

    12. Issuance of an act for the right time compensated (long, short), land (rent) personally by the consumer or the trustee with the provision of powers of attorney, receipts, and an identity document the customer or a trustee.
    The consumer or his authorized representative shall sign a receipt in the book of registration and issuing of acts for the right to permanent use.
    In cases where the consumer is not applied for obtaining the documents in time, the authority provides for the keeping of six months, and then transfers them to the archives of the specialized enterprise.
    At the Center for issuance of documents prepared by the inspector to the consumer through the Centre "windows" on the basis of a receipt given to her period.

    In cases where the consumer is not applied for obtaining the documents in time, the Center provides them with storage for 1 month and then transmits them to the authority.
    13.Etapy provision of public services after receiving the request from the consumer to receive state services and to the time of the result of the public service is shown in Appendix 2 to this Regulation.

    Description of the order action in process of the rendering state facilities

    14. The statement from the customer is logged incoming correspondence IOI and entered into the database EUOL AIS (Automated Information System accounting treatment of single individuals).
    15. The act granting the right to temporarily compensated (long, short), land (rent) must provide to the authority or the PSC the following documents:
    1) the provision of temporary state of compensated (long, short) use (rental):
    statement to the authority for granting the right to act temporarily compensated (long, short) use (lease), in accordance with Annex 1knastoyaschemu regulations;
    copy of an extract from the decision of the local executive body for the provision of temporary Paid (long, short) use (lease);
    copies of land use project approved by competent authority, and materials for the establishment of land boundaries on the ground;
    if land use project allocation of land on the ground for removal under individual housing construction is part of the land use project on a particular plot of land and materials to establish its boundaries in the area, issued by the organization, do the work;
    A copy of the taxpayer (TRN);
    A copy of state registration of legal persons;
    copy of a receipt for payment of services for the production act for the right time compensated (long, short) use (lease);
    copy of the identity of the person who has been granted the right to permanent use. or a copy of power of attorney from the person who granted a temporary Paid (long, short) use (lease), and a document certifying the person authorized.
    To validate your copy of ID of the person or proxy are presented original documents, which, after checking back to the consumer;
    2) in the case of a change of identification characteristics of land:
    statement to the authority for granting the right to act temporarily compensated (long, short) use (lease), according to Annex 1 to this Regulation;
    copy of an extract from the decision of the local executive body to change to a previously unidentifiable granted land on the right of temporary Paid (long, short) use (lease) and / or other document confirming the change of identification characteristics of land, copies of land use project approved by competent authority, and materials to establish the boundaries of land in the locality, a copy of the taxpayer (TRN);
    A copy of state registration of legal persons;
    copy of a receipt for payment of services for the production act for the right time compensated (long, short) use (lease);
    copy of the identity of the person who has been granted the right to temporarily compensated (long, short) use (lease), or a copy of power of attorney from the person who granted a temporary Paid (long, short) use (lease), and a document certifying the person authorized .
    To validate your copy of ID of the person or proxy, the original documents are presented, which, after checking back to the consumer;
    3) the act of issuing a duplicate at the right time compensated (long, short) use (rental):
    statement to the authority for issuing a duplicate instrument for the right to permanent use. according to Annex 1 to this Regulation, a copy of a receipt for payment of services for duplication on the right to act temporarily compensated (long, short) use (lease);
    copy of the identity of the person who has been granted the right to permanent use. or a copy of power of attorney from the person who granted a temporary Paid (long, short) use (lease), and a document certifying the person authorized;
    copy of the local regional newspaper, the location of the land to the published announcement of the recognition of the original act for the right time compensated (long, short) use (lease) invalid.
    To validate your copy of ID of the person or proxy are presented original documents, which, after checking back to the consumer.
    16. The information obtained from the applicant is confidential.
    17. Text description of the sequence table and the interaction of administrative actions (procedures), SFU, indicating the timetable for administrative action, is shown in Appendix 2 of this Regulation.

    19.Deyatelnost authorized body and the center based on the following principles:
    1) observance of constitutional human rights and freedoms;
    2) the rule of law while on duty;
    3) comity;

    security and privacy;
